Costa Rica Real Estate – A Booming Decade-But Are The Boomtimes Over?

 

One of the smallest countries in the world, Costa Rica is famous for its sandy beaches, spectacular coastal landscape, and its incredible diversity of plants and animals. In fact, though it is only about the size of West Virginia, nearly 20% on earth are found in that little country. Tourists flock to it in droves each year making it one of the hottest tourist destinations in Latin America. The majority of tourists are from America and Canada, of course, but there are also thousands of European travelers. In order to cater to the booming tourism industry, hotels, resorts, golf courses, restaurants, pubs, shopping malls, and other tourist attractions have popped up alongside beaches and other hot spots. This resulted in a sharp rise in Costa Rica real estate value over the last ten years since land is one commodity that is not plentiful in Costa Rica, a country with just one tenth of one percent of the world’s land mass.

This relative scarcity of available real estate in the face of development has resulted in a boom in new condos and homes along the coasts, in the mountains, and in urban areas.

The demand for real estate has been concentrated mostly in areas where the tourist influx is large particularly along the Pacific coast. The purchase of vacation property and real estate for relocation by expatriates are two main reasons why the property prices have gone up. In addition to the coasts, money is flowing into investments on farms (called fincas), mountain properties, and vacation rentals. Increasingly, Costa Rica is also being seen as a retirement destination by many retirees hailing from cold countries in Europe as well as America and Canada. The highly stable democratic political system and the beauty of this country attract real estate purchasers from around the world who want to have a piece of paradise to themselves. Costa Rica is one of only two countries in the world without an army, the other being Switzerland, and is extremely forward looking. The government is committed to sustainability and in a few years, Costa Rica will be the first country on the planet to have a zero carbon footprint. No wonder so many people fall in love with this place.

A number of years ago, the country realized the benefits of sustainable development and tourism. Unlike many other countries, Costa Rica has learned the lesson that unregulated exploitation of resources is ultimately detrimental. Despite today’s uncertain economic climate in the States and Europe, the general perception is that there will be a large rebound in Costa Rica real estate. Why? One reason is the incessant flow of investments based upon the lucrative returns to be had from property development. Another is that, in comparison to the Unites States and Europe, real estate prices, particularly on sunny, tropical coastlines remain incredibly reasonable. Land prices along the coasts are still just a fraction of the cost elsewhere. Further, real estate investors have found extraordinary returns on their investments over the last decade.

The beach properties along the Pacific coast have seen, and will probably see, the largest increase in prices over time. The Caribbean coast remains relatively undeveloped. Certainly prices there, like all of Costa Rica, are rising but not nearly as much as on the other coast (which, of course, means that stress on prices have been less lately than on the Pacific side). And, as more and more Ticos move from the country into the big urban area around San Jose, available prime property has become increasingly scarce. Demand remains strong in the urban areas and, for more and more expats who live in Costa Rica, the amenities and climate around San Jose are proving irresistible.

Brazil is booming and for foreign travel and international property investments, it is currently the country of choice. People are flocking there in droves to enjoy its year-round climate, clear Atlantic waters, and vibrant atmosphere.

And Brazil is also home to some of the worlds most vibrant and healthy foods. The Amazon region is swathed in tropical fruits bursting with vitamins and antioxidants and these have rapidly found their way into Brazilian juice bars across the country. Pupunha, capuau, grumixama their names are as exotic as their flavours. It is one berry in particular though, that of the aai plant, that has almost single-handed sparked the health food celebration that is taking Brazil, the US and Europe by storm.

The benefits of acai are not a new discovery amongst the Brazilians. It has long been used by those in the know for its nutritional value as well as to enhance physical strength and boost energy levels. The fruit itself is grown on the native Amazonian acai palm and comes in the form of small, purplish berries roughly the size of a blueberry.

The reputation of this unassuming little berry is now well and truly blooming. The Lawyers role in Brazilian Real Estate Purchases, part 1.

 

Buying property can be a complicated process. Buying property abroad, where you may not speak the language, be familiar with the culture or understand the legal system may seem even more complex. In fact the system is very straightforward as long as you have access to the right legal advice and reliable local representation

Obviously one of the main criteria in selecting a lawyer to act for you will be the sharing of a common language and experience of working with non-resident real estate transactions. The OAB, Brazilian Bar Association, has a register of accredited lawyers and they have a published scale of fees for the legal work they carry out.

Your legal representative will advise you on your real estate purchase, contract, legal implications of the transaction and to some extent the tax consequences of the purchase. Brazil has very straightforward property laws and if the correct documents are in place the acquisition can be very swift. In older properties or land purchases, these documents may not be available and it is your lawyers duty to collect these documents and confirm their validity.

The above services are generic because different types of property will require a different type of due diligence investigation. An off plan apartment will be fairly easy to check with regard to documentation as the majority of the documents required will have been prepared by the constructor as part of the planning permission process. If the property you are purchasing is a country or beach property then a far more detailed investigation must be made, with an historical ownership record to ensure that your ownership will not be challenged in the future and that the person selling is authorised to do so.

If you are buying a plot of land then the same checks with regard to title will be made but you will also require a survey of the land to be carried out in order to obtain its exact measurements and to identify its borders. This study will also include details on the planning status of the land, which will show you what can be built, and a detailed plan that will form part of your final title deed.

When your lawyers have confirmed that the property is legally ready for sale, with all documentation in place, you will then sign the purchase contract known as, contrato de compra e venda. The contract details all of the information with regard to the purchase such as the seller, the buyer, description of property, price and so on. Importantly it also sets out the date that you can take possession of the property.

With the contrato de compra e venda signed by both parties and with the deposit paid, the contract becomes a legally binding document. The amount payable as deposit at this stage and the structure of payments until completion varies, particularly in the case of off plan property purchase as different developers offer different payment schedules and incentives.

When all of the payments are complete and the appropriate transfer taxes are paid, you will receive title to the property, ensuring your full legal ownership.
